Terms of Sale
1. Who you are buying from
These terms apply to every order placed through The Loot Hut at theloothut.com, including orders placed through our client-branded shops.
The products are personalised and made to order by The Loot Hut, a trading name of ESPI Group Limited, a company registered in England and Wales (company number 09114924), registered office 483 Birmingham Road, Marlbrook, Bromsgrove, Worcestershire, B61 0HZ.
Although a product may carry the branding of the shop you ordered from, your contract of sale is with ESPI Group Limited trading as The Loot Hut ("we", "us", "our"). We are the seller and we are responsible for fulfilling your order and for your statutory rights as a consumer. The brand featured on the product is not a party to this contract.
You can contact us at hello@theloothut.com.
2. These terms
By ticking the box to accept these terms at checkout, you confirm that you have read and agree to them. If you do not agree, please do not place an order. We recommend you save or print a copy for your records. The version of these terms you accept at checkout is the version that applies to your order.
3. The products
Every product is made to order and personalised. This means one or both of the following:
- it is produced specifically for you after you order, rather than taken from general stock; and/or
- it carries personalised content, which may be the shop's branding, a design you select, and/or a name or text you supply.
Because production only begins once you have ordered, your item is made to your order and is not a stock item we can resell.
Product images and on-screen colours are shown as accurately as possible, but small variations in colour, finish and engraving can occur and are not a defect.
4. Your order and our contract
When you complete checkout and payment, you are offering to buy the product. We accept your order, and a contract is formed, when we send you an order confirmation by email. If we cannot accept your order (for example, the item or colour has sold out, there is an error in the price or description, or we cannot complete the personalisation), we will tell you and refund any payment taken in full.
5. Personalisation: please check carefully
Where you supply a name, spelling or other text, you are responsible for making sure it is correct. We produce the item exactly as the details are submitted at checkout. We cannot offer a refund, replacement or exchange for personalisation errors caused by incorrect or misspelled details that you provided.
We may decline to produce personalisation content that is unlawful, offensive, infringes someone's rights (including trade marks or copyright), or that we otherwise reasonably consider unsuitable. If we decline, we will refund you in full.
6. Price and payment
Prices are shown in pounds sterling (GBP) and include VAT where applicable. The price you pay is the price shown at checkout at the time you order.
Payment is taken at checkout through Stripe, our payment provider. We do not see or store your full card details. Your card statement will show the payment as THELOOTHUT.
7. Delivery
We deliver to addresses in the UK only. We aim to dispatch your order within 5 working days and to deliver within 2 working days of your order confirmation. Delivery costs, if any, are shown at checkout.
These timescales are estimates and are not guaranteed. We are not responsible for delays caused by the courier or by events outside our reasonable control, but we will always help you chase a delayed parcel.
Risk in the goods passes to you on delivery. If you give us an incorrect or incomplete delivery address, we may charge you the cost of re-delivery.
8. Cancellations, returns and refunds
Please read this section carefully before you order.
The products are made to your order and personalised. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the normal 14-day right to cancel a distance purchase does not apply to goods that are made to a consumer's specifications or are clearly personalised.
This means that once your order is confirmed, it cannot be cancelled, returned or exchanged, and is not refundable, simply because you have changed your mind, ordered the wrong item or no longer want it. Production is specific to your order.
This does not affect your rights where an item is faulty or not as described (see section 9), and it does not affect your statutory rights generally (see section 11).
9. Faulty, damaged or incorrect items
Your legal rights as a consumer are not affected by anything in these terms. If your item arrives faulty, damaged, not as described, or different from what you ordered (for example, we have made a mistake with the colour, design or personalisation), we will put it right.
Please contact us at hello@theloothut.com within a reasonable time of delivery, with your order number and a photograph of the issue. Under the Consumer Rights Act 2015 you may be entitled to a repair, a replacement or a refund. Where the fault is ours, we cover any return postage and the cost of putting it right. You do not need to pay for a replacement of a faulty or incorrect item.
10. Our liability
We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for any of your statutory rights as a consumer.
Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms, but we are not responsible for loss that is not foreseeable. We do not supply the products for business use and we have no liability to you for any business loss.
11. Your statutory rights
Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 that goods will be of satisfactory quality, fit for purpose and as described. For free, independent advice about your rights, contact Citizens Advice at citizensadvice.org.uk.
12. Your personal data
We handle your personal data in line with our Privacy Policy, which explains what we collect, how we use it and your rights.
13. Complaints
If something has gone wrong, please contact us first at hello@theloothut.com and we will do our best to resolve it. We aim to acknowledge complaints within 2 working days.
14. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the version you accepted at checkout when you placed it.
15. Governing law
These terms and any contract formed under them are governed by the law of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
